Terms of Service

1. Acceptance of Terms

You must read and accept these Terms before using Examon. If you do not agree, do not use the platform. You also agree to our Privacy Policy, which explains how we handle personal data.

2. Eligibility and Accounts

You must be at least 13 years old to use Examon. If you are under 13, a parent or legal guardian must provide consent before account creation. If you are under 18, you should review these terms with a parent or guardian.

You are responsible for account security, including your password and login details. You must provide accurate information and keep your details up to date.

3. Description of the Service

Examon provides AI-assisted VCE study tools, including generated questions, marking support, learning recommendations, and progress tracking. Examon is a study aid and not a substitute for classroom teaching, tutors, official curriculum resources, or professional academic advice.

4. Subscription Plans, Billing, and Cancellation

Examon offers Free, Academic, and Selective Entry plans. Paid Academic and Selective Entry plans are $40/month, or the equivalent of $35/month when billed annually. Paid plans are processed securely by Stripe. By purchasing a paid plan, you authorize the applicable payment and fees.

Paid subscriptions renew automatically each billing cycle unless cancelled before renewal. You can manage or cancel through your billing portal. Cancellation stops future charges but does not automatically refund prior charges except where required by law or under our refund policy below.

5. Refund Policy

Paid subscriptions may be eligible for pro-rated refunds for the unused portion of the current paid period, assessed in good faith at our discretion and subject to Australian Consumer Law where applicable.

6. Intellectual Property

The Examon platform, interface, branding, software, and generated study content are owned or licensed by us and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the service for personal educational use.

You retain ownership of original responses, submissions, and personal study materials you create in the platform. By submitting content, you grant us a limited license to store, process, and use it to provide and improve the service.

7. AI Content Disclaimer

Examon uses AI systems (including DeepSeek, OpenAI, and Anthropic). AI-generated content may be incomplete, outdated, or incorrect. You must independently verify important academic information. We do not guarantee specific marks, study outcomes, ATAR results, or exam performance.

8. Acceptable Use

You agree not to:

• share, sell, or transfer your account access to another person;
• scrape, crawl, reverse engineer, or systematically extract platform content;
• use the service to cheat, plagiarize, or violate school/exam integrity rules;
• upload unlawful, harmful, or infringing material;
• interfere with platform security or availability.

9. Suspension and Termination

We may suspend or terminate access if you breach these Terms, misuse the platform, or create risk to other users or our services. You may stop using Examon at any time. Termination does not remove obligations that are intended to survive (for example, payment obligations and legal disclaimers).

10. Limitation of Liability

To the maximum extent permitted by law, Examon is provided "as is" without warranties of uninterrupted availability, accuracy, or fitness for a particular purpose. We are not liable for indirect, incidental, special, or consequential loss, including lost study time, lost data, or exam outcomes.

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Victoria, Australia. You agree that disputes will be subject to the courts of Victoria, unless applicable law requires otherwise.

12. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice by email or through the service. Continued use after updates take effect means you accept the revised Terms.
